Rule 42
Non-timber forest produce and herbaceous use
(1) Except for non-timber forest products and herbs which are prohibited according to the prevailing law, the council may grant permission based on the approved action plan and technical report to sustainably collect, use and take non-timber forest products and herbs within the conservation area.
(2) The Council shall determine the fee for the license to collect non-timber forest produce and herbs and take them out of the area. However, the fee to be determined in such a way cannot be determined in such a way that it is less than the fee prescribed under the Forest Regulations, 2051.
(3) The Council shall determine the list of non-timber forest products and herbs that can be collected and used from the conservation area and taken out of the conservation area.
(4) If the non-timber forest produce and herb protection determined according to sub-rule (3) is of community forest, the recommendation of the chairman of the relevant committee to take such non-timber forest produce and herb to the sustainable collection, utilization and protection area and assigned by the Government of Nepal in accordance with sub-rule (1) of rule 57 Based on the report of the technician, the chairman of the council can grant permission.
(5) In the case of permission to collect, use and take herbs outside the protected area according to sub-rule (2), seventy-five percent of the fee received from the area of the committee in which the permit has been granted, the council shall provide to the said committee.
(6) According to this rule, any person or organization who wants to collect, use or take any herb out of the conservation area shall submit an application to the council in the format as per schedule-12.
(7) If an application is received according to sub-rule (6), the council may grant a permit for collection of vegetation in the format as per schedule-13.
(8) If the herb collected as per sub-rule (7) has to be taken out of the conservation area, the chairman will give permission in the format as per schedule-14. However, before giving leave, the chairman can check whether or not the collection of herbs is according to the amount given.
(9) If any vegetation is brought into the protected area from outside the protected area or by using the road of the protected area.The person or organization who wants to take the plant outside must submit the license issued by the relevant district forest office to the chairman and the chairman will give permission to bring such plant into the protected area or take it outside the protected area after making necessary checks.
